This section tells you what is included in the Base Fee, what you pay extra for, and cancellation/rescheduling and payment information.
Full-Day 2 Party Case: $1400 Base Mediation Fee per Party.
The Full-Day 2 Party Base Mediation Fee includes up to an 8 hour mediation session on the day scheduled and up to 2 hours (per Party) Pre-Mediation Preparation time (reviewing documents, discussions with Counsel, etc.) and 1.5 hours (total) Post-Mediation Follow-up. Although usually not necessary, if there is Additional Pre-Mediation Preparation time incurred, the fees will be charged to the submitting Party. Also, although not usually needed, if there is Additional Post-Mediation Follow-up time incurred, the fees will be divided and charged equally among the Parties. Additional fees, if any, will be charged at $450 per hour (in tenth of an hour increments) and billed after the Mediation session. Payment of the Additional fees is due within 15 days of receipt of the invoice. If your Full-Day Mediation is held in my Austin office, parking is validated (when you park in the One Congress Plaza Garage located at 133 Brazos St. and you bring your parking ticket to my office for validation) and lunch is provided. If the Full-Day Mediation is not held in my offices, then the Parties are responsible for all costs for the facility, lunch, food, beverages and parking.
Half-Day 2 Party Case: $700 Base Mediation Fee per Party.
The Half-Day Base Mediation Fee includes up to a 4 hour mediation session on the scheduled day and up to 1 hour (per Party) Pre-Mediation Preparation time (reviewing documents, discussions with Counsel, etc.) and 45 minutes (total) Post-Mediation Follow-up. Although usually not needed, if there is Additional Pre-Mediation Preparation time incurred, the fees will be charged to the submitting Party. Also, although not usually needed, if there is Additional Post-Mediation Follow-up time incurred, the fees will be divided and charged equally among the Parties. Additional fees, if any, will be charged at $450 per hour (in tenth of an hour increments) and billed after the Mediation session. Payment of Additional fees is due within 15 days of receipt of the invoice. If your Half-Day Mediation is held in my Austin office, parking is validated (when you park in the One Congress Plaza Garage located at 133 Brazos St. and you bring your parking ticket to my office for validation). The parties are responsible for the facility, parking and other costs if the Half-Day Mediation is not held in my offices.
Full-Day Multi-Party Case: $1000 Base Mediation Fee per Party (if the complexity of the dispute or number of parties will require implementation of settlement protocols or multiple sessions, please contact me to discuss process and costs).

Rocket Mediation 2 Party Case: $450 Base Mediation Fee per Party.
The Rocket Mediation Base Fee includes up to a 3 hour mediation session on the day scheduled and 1 hour (total) Pre-Mediation Preparation time (reviewing documents, discussions with Counsel, etc.) and no Post-Mediation Follow-up, unless the Parties request it. If Post-Mediation services are requested, the fee for Additional time incurred will be charged at $450 per hour (in tenth of an hour increments). Payment of the Additional fees is due within 15 days of receipt of the invoice. If your Rocket Mediation is held in my Austin office, parking is validated (when you park in the One Congress Plaza Garage located at 133 Brazos St. and you bring your parking ticket to my office for validation). No lunch is provided. If the Rocket Mediation is not held in my offices, then the Parties are responsible for all costs for the facility, food, and parking.
Travel Costs and Fees
If your mediation is held outside of Travis, Hays, Williamson or Bastrop County, Texas, travel time is billed at $125 per hour, plus meals, lodging, and incidental expenses (taxi, rental car, tips, etc.).
If air travel is necessary, airfare will be billed at coach fare rate.
Car travel is billed per mile at the current IRS Standard mileage rate used to calculate the deductible costs of operating an automobile for business purposes (2015 rate is $57.5 per mile).
Travel costs will be divided equally among the Parties and usually billed to the Parties after the Mediation. Payment is due within 15 days of receipt of the invoice.
Cancellation and Rescheduling
Once your Mediation is scheduled and confirmed, you can cancel up to 72 hours before the scheduled start time of your Mediation, by notifying me and my assistant via email at mdietz@Dykema.com and mruiz@Dykema.com. You can also call us at 512-703-6322 or 512-703-6309. If you cancel your Mediation with less than 72 hours notice, each Party may be charged a Cancellation Fee of up to 50% of your Base Mediation Fee per Party. If your Mediation is rescheduled and held at the rescheduled time, the Cancellation Fee is waived.
Payment Information
Your Base Mediation Fee is to be delivered/mailed to my office in advance of the Mediation. Dykema Cox Smith's tax identification number will be provided to you along with Confirmation of your scheduled Mediation. Payment of Additional Fees is invoiced after the Mediation and is due within 15 days of the receipt of the invoice.
